The Court of Appeal held that the contempts for scandalising the court were criminal contempts constituting convictions of criminal offences for the purposes of Article 13(4)(d) of the HKIE Constitution; therefore the Board of Inquiry's finding of improper conduct and the council's suspension order were founded on established convictions and the plaintiff's claim challenging the suspension disclosed no reasonable cause of action, was frivolous or vexatious and an abuse of process and was rightly struck out.

O.14A was inapplicable because its statutory condition that the question, whichever way decided, must finally dispose of the claim was not satisfied: a negative answer would not finally determine the plaintiff's claim and there are disputed facts (including allegations of forgery and requests regarding the mark) and inadmissible hearsay in affidavits which require resolution at trial; hence the Master was right to refuse the O.14A application and the appeal is dismissed.
