    Costs application refused: because the defendant was convicted of the statutory lesser offence he was not acquitted of all offences after trial for the purposes of s.5 CCCO, and awarding costs for the acquitted dangerous driving charge would be unjust where the defence of both charges materially overlapped and no separate additional costs were incurred; the prior offer to plead did not entitle him to costs once he chose to defend at trial.

    The murder conviction was quashed because the issue of provocation should have been left to the jury; because the evidence before the jury (including the appellant's admission) was legally capable of supporting provocation and because the prosecution had during trial indicated willingness to accept a plea to manslaughter on provocation, it would be unfair to order a retrial; accordingly under s83A(2) Cap.221 the Court substituted a conviction for manslaughter on the ground of provocation and adjourned sentence.
