Leave to appeal was not required because the order refused to allow an amendment introducing a new claim and thus fell within s.14AA and Order 59 r.21(2)(i); alternatively the Judge properly exercised her discretion to refuse the belated amendment to plead fraud because of substantial unexplained delay, inconsistency in pleadings, lack of merit and prejudice to the plaintiff; extension of time was refused and the application dismissed with indemnity costs of HKD 90,000.
