Although the trial judge's remarks showed a material irregularity in forming a firm conclusion at the close of the prosecution case, the Court held that no miscarriage of justice occurred because the evidence was ample to support the presumption and nothing material occurred after the remarks that could have changed the outcome; therefore the conviction was safe and the appeal was dismissed.
