On the pleadings the court found SKDO consent was not obtained and the plaintiffs returned the initial deposit; therefore the 1st Agreement was terminated. The court granted a declaratory judgment that the 1st Agreement is terminated and ordered the registration of the 1st and 2nd Agreements in the Land Registry to be vacated. The court refused the additional declaratory relief in paragraph 1(b) of the summons because it was not pleaded in the statement of claim and the plaintiffs conceded no amendment would be sought.
