The expression "occupation permit" in the sale agreements must be read to mean the document which permits lawful occupation of the unit in question; for the Regency Court small houses that document is the Certificate of Compliance (given the Certificates of Exemption under Cap.121), therefore the third instalment became payable upon issuance of that certificate; the purchasers' rescission claim failed and the appeal was dismissed; misrepresentation arguments were not pleaded and the vendor's title argument failed because good title is only required at completion.
