The SWD was unjustly enriched by reducing the CCSA Rent Subsidies when PRH rents were reduced or waived because the benefit was intended for tenants including the claimant, the reduction saved a necessary expenditure of the defendant at the claimant's expense, and it was unjust for SWD to retain that saving; restitution was therefore ordered in favour of the claimant.
