The Court held that the prosecution failed to prove employment beyond reasonable doubt because the evidence consisted only of a brief observation and lacked nexus to any employer, payment, instructions or control; the magistrate impermissibly drew inference from inference and the conviction was unsafe and quashed.

The magistrate was entitled to accept PW1 and PW2 as honest and reliable; their evidence established an irresistible inference that the appellant took employment in breach of s38AA, therefore the conviction and the imposed sentence are not unsafe or excessive.

The appeal was dismissed because the period of administrative detention (11 months) was unrelated to the offences committed after the appellant's unlawful reentry and therefore the sentencing court was not required to give credit for that detention; there was no basis to regard the 15 month total sentence as manifestly excessive.

The Magistrate correctly applied the precedent in HKSAR v Usman Butt & Another to adopt an appropriate starting point, properly allowed the limited deduction for 10 days administrative detention, and there were no exceptional circumstances (including medical complaints) warranting interference; therefore the sentence of 22 months imprisonment is not wrong in principle nor manifestly excessive and is upheld.

The magistrate lawfully exercised sentencing discretion by applying the established benchmark, granting a generous 3-month humanitarian discount plus custody credit, and the Court of First Instance found no error in that exercise of discretion and dismissed the appeal.

Judge accepted that the appellant's evidence could be acted on given the incontrovertible entry chop and the incentive to lie, concluded the mischief was substantially that of simple overstaying, quashed the 15 months immediate custodial sentence for unlawfully remaining and substituted a sentence appropriate to overstaying (28 days suspended for 2 years) to reflect sentencing practice and individual justice.

The magistrate was entitled to disbelieve the appellant's testimony in light of the admitted facts and passport movement record (Exhibit P3) which compelled the inference of unlawful landing after 24 December 2004; consequently the conviction was safe, and the 16-month sentence (after lawful review under s.104(5)) was within lawful bounds and not manifestly excessive.

The court held that the magistrate's starting points and application of guilty‑plea discounts were appropriate given repeated unlawful entries using forged documents and undermining of border integrity, and that the global sentence of two years and four months was not manifestly excessive; the appeal was dismissed.

Where the aggregate of appropriate sentences reaches the magistrate's jurisdictional maximum the court must nevertheless reflect credit for a guilty plea by imposing a total sentence less than that maximum; accordingly the magistrate's order making both 18‑month sentences wholly consecutive was quashed and substituted so that only 12 months of one sentence is consecutive, producing a total of 30 months imprisonment.
