Leave to appeal against conviction was granted because it was reasonably arguable that counsel did not properly handle a core late instruction from the client (that PW1 was not the interviewing bank employee) and that counsel should have sought time to advise the client and, if persisted in, put the instruction to the witness; leave to appeal against sentence was refused because the sentencing judge's reasoning was open to the judge's assessment of aggravating features and the sentence of 3 years was not shown to be excessive or erroneous.
