The Court held that documents obtained under compulsion (B106 and B108) ceased to be protected by the implied undertaking once they were filed, marked and used/read in open court and thus were public documents; the High Court erred in applying Harman (majority) to maintain the implied undertaking and in concluding the Kuantan/Temerloh proceedings were collateral. Leave to commence committal and leave to use documents were wrongly granted; appellants entitled to use the documents in related proceedings without prior leave. High Court orders set aside and appeals allowed with costs.

Court of Appeal allowed both appeals, set aside the High Court orders dated 23.8.2024 and held that documents B106 and B108, having been filed, marked and used in open court, were public documents such that the Riddick implied undertaking ceased in respect of those documents; the Kuantan/Temerloh judicial review and originating summons were related proceedings (not collateral/ulterior) so leave was not required to use the documents; applications to strike out and to adduce further evidence were dismissed; costs awarded to appellants (RM50,000 and RM35,000).

The appeal was allowed because the Sessions Court was wrong to infer an implied undertaking where the defendant had expressly refused any undertaking and the payer acted with full knowledge; the Prohibitory Order had lapsed under section 338(5) NLC and did not impose a duty on the chargee to procure its removal; written authority showed the solicitor acted for the Chargor; accordingly there was no contractual or restitutionary basis to require refund and the Sessions Court's judgment was set aside.

The court released the implied undertaking and granted leave to use the Anton Piller materials because the documents are central and relevant to multiple pending and prospective civil and criminal proceedings, no demonstrable prejudice to defendants was shown, several defendants expressly did not object and the 1st–4th Defendants' failure to file an affidavit in reply or give instructions amounted to acquiescence; the public interest in resolving the matters and enforcing court orders outweighs confidentiality concerns, so the use is permitted with costs and orders as prayed in Enclosure 196.
