Clause 20 unambiguously requires water and electricity to be connected to the house itself before vacant possession is treated as delivered; inability to obtain CF or that supply reached the estate/substation does not excuse the developer's contractual obligation, so the magistrate erred and the appeal is allowed.
The phrase "with the connection of water and electricity supply to the said building" requires that water and electricity supplies be actually running through the internal water pipes and electrical wiring (i.e. meters installed/energized) before vacant possession can be said to have been delivered; since supplies were only effected on 24 February 1993 there was delay and the respondents were entitled to liquidated damages; appeal dismissed.
The 1989 Regulations unambiguously require that vacant possession be delivered only when water and electricity supply have been connected and are energised into the building; therefore the developer was liable for late delivery until utilities were energised.
