The SLA Defendants breached their statutory and common law duty by failing to record the Malay Reserve endorsement in the computerized land register; the plaintiff relied on that inaccurate register and sustained actual, foreseeable loss when the Court of Appeal declared the transfer void on 9.10.2018; the cause of action accrued on that date so the claim was timely under PAPA 1948; accordingly the plaintiff is entitled to compensatory damages for the purchase price.

On the balance of probabilities the court found that Lew Tin Kwy was the beneficial owner of the claimed fractions (3/24 of GRN 342328 and 3/22 of GRN 342329) as evidenced by the 1971 sale and attendant materials; the 3-acre parcel corresponds to those fractions; the applicant as administrator is entitled to be registered; and the court may, pursuant to s.417 KTN read with r.92(4) Kaedah-Kaedah Mahkamah 2012, order the Director of Lands/Registrar to register the transfers without requiring a separate proceeding to enforce the decision. Therefore the application was allowed.

2nd Defendant (land office) owed statutory and common law duties to maintain accurate register and search results; it breached those duties by allowing the creation/entry of a non‑genuine/erroneous Grant 27889 and by failing to produce critical documents, justifying an adverse inference; as a consequence the cancellation performed was wrongful and the court restored the Plaintiff as registered proprietor and ordered cancellation of the competing title; large claimed economic losses were too remote and not recoverable, but costs were awarded to Plaintiff.

The appeal is dismissed because the claims are barred by res judicata and issue estoppel as the same subject matter and issues were finally adjudicated in earlier proceedings and the kin enquiry/compromise agreements, and because the claims are time‑barred under Limitation Act 1953 s9(1) since the plaintiffs could with reasonable diligence have discovered the alleged fraud earlier (s29 did not postpone limitation to save the claim); additionally the suit constituted an abuse of process, so striking out was plain and obvious and the High Court's order was correctly affirmed.
