On the balance of probabilities the court found that Lew Tin Kwy was the beneficial owner of the claimed fractions (3/24 of GRN 342328 and 3/22 of GRN 342329) as evidenced by the 1971 sale and attendant materials; the 3-acre parcel corresponds to those fractions; the applicant as administrator is entitled to be registered; and the court may, pursuant to s.417 KTN read with r.92(4) Kaedah-Kaedah Mahkamah 2012, order the Director of Lands/Registrar to register the transfers without requiring a separate proceeding to enforce the decision. Therefore the application was allowed.
