Consequently Suit 121 dismissed and Suit 184 allowed for vacant possession with costs.

Court held that measurements in Qualified Titles are provisional and the proper statutory route after final survey is recomputation under s.84 and referral under s.83; the High Court erred in ordering re-survey/cancellation of certified plans and in granting orders affecting the 4th defendant because the claim against it had been struck out and it held an indefeasible final title under s.92 and s.340 NLC; accordingly the High Court orders were set aside and parties ordered to bear their own costs.

The survey plan was inadmissible as conclusive evidence because the actual surveyors and preparers did not give direct oral evidence and the plan rested on hearsay; combined with the provisional nature of boundaries under qualified title and absence of proof of loss, the plaintiff failed to prove encroachment or damages and is not entitled to the injunctive relief sought.
