The Court dismissed the judicial review because New Zealand authorities did not procure or connive in the Australian removal, the removal was lawful under Australian law (s198 Migration Act), communications and administrative flight changes did not convert the lawful removal into a disguised extradition, the applicant failed to prove misconduct amounting to an affront to public conscience, and therefore no stay of proceedings was justified.
