Failure to discuss every argument does not constitute a special reason to recall a judgment; recall is available only where a genuine special reason exists and absent that remedy the proper course is leave to appeal; accordingly the recall application is dismissed and costs awarded for a meritless recall application.

Leave to appeal was granted because there is an issue of law of general and public importance whether the Employment Court should, by analogy, adopt the High Court Rules approach to assessing costs (daily recovery rates rather than actual costs) and whether allegations of fraud affect entitlement to costs; appeal hearing deferred until fraud allegations are resolved in the Employment Court.

The applicant pursued an unmeritorious pre-commencement discovery application, resiled from a settlement/discontinuance agreement and thereby caused BNZ to incur significant unnecessary costs; accordingly increased costs were warranted under r 48C (and r 48C(4)), and a costs award of $15,000 to BNZ is appropriate after taking into account BNZ's concession to accept reduced indemnity costs and the applicant's financial position.
