The statutory scheme limits total home detention to a maximum of 12 months; the Court of Appeal lacked jurisdiction to impose a fresh 12-month home detention sentence that, combined with time previously served, would require more than 12 months' home detention in total. The appropriate remedy on this second appeal is to vary the Court of Appeal sentence to one that does not exceed the statutory maximum by reducing the home detention term to eight and a half months with a backdated start date (30 July 2019), retain post-detention conditions, and remit remaining community work.

The Court concluded there were sufficient grounds to allow the appeal on charges 13 and 14 and entered judgments of acquittal on those charges; it found no reversible error in respect of the remaining convictions and upheld the refusal to grant a discharge without conviction; the sentence was varied to six months' home detention and otherwise the post-detention conditions were retained.

The judge erred by failing to account for the portion of the original sentence yet to be served when converting imprisonment to home detention under s 80K(6); the correct approach required calculating remaining imprisonment (five months) and converting to an equivalent home detention term (two months and two weeks). The ten month home detention was therefore quashed and substituted with two months and two weeks home detention starting 16 July 2019, with standard and specified special post-detention conditions expiring six months after completion.

The post-detention conditions are retained because they are directly related to the offending for which the appellant remains convicted, are rehabilitative in purpose, and are not disproportionate; consequently the appeal against sentence is dismissed. A publication prohibition of the judgment and proceedings until final disposition of the retrial is necessary to protect the appellant's fair trial rights.
