A s109 reassessment that includes a VIOA permits challenge to that VIOA; however the earlier final District Court judgment (Judge Joyce QC) established by issue estoppel that the Automotive Parts Salesperson work type is occupationally suitable for Mr Horne, so the only live question was medical suitability as at the reassessment date; the medical evidence of Dr Hartshorn was preferred as contemporaneous and comprehensive, so the role was medically suitable and appellant was vocationally independent as of 12 December 2012, entitling dismissal of the appeal.
