The Court allowed the appeal because the applicant had a good arguable case that the funds were held by the first respondent as trustee and the evidence (trust deed, account operation by third parties, trustee's absence overseas, and disclosed term deposit of approximately NZD 706,968) established a real risk that the funds could be dissipated or moved offshore; on balance of convenience a without‑notice freezing order preserving all funds in the ANZ accounts pending prompt proceedings is justified.
