The recall application was granted but on the substantive issue the Court held s 21B does not provide cover for the appellant's PTSD because the incidents of false imprisonment were not 'sudden' in the sense required by s 21B and did not together comprise a single incident or occasion under s 21B(7)(b); however s21B is not prevented from applying where the causative events pre-dated 1 October 2008 if treatment occurred thereafter (s36(1)).
