    Having considered overall success and conduct, and that the parties reached a compromised settlement at FDR with each side achieving some of their aims and some unreasonable positions (notably the mother's exaggerated removal cost claim), the court ordered the father to contribute 50% towards the mother's costs of and occasioned by the ancillary relief proceedings, to be taxed on a party and party basis if not agreed, including the costs of the application and with a certificate for counsel.

    Applying Order 62 rules 3(2A) and 5 and weighing conduct, Calderbank material, and the wife’s failure to provide a proper breakdown and her exaggeration of future costs, the court exercised its discretion to divide costs: the husband to pay two‑thirds of the costs of the summonses and a costs order nisi that the wife pay one‑third (to be taxed if not agreed), with the nisi to become absolute after 14 days absent an application to vary.
