The court found the applicant's ex-parte affidavit contained material misrepresentations and omissions regarding whether the PRC courts had dealt with the Hong Kong properties; those misrepresentations and non-disclosures had materially misled the court in granting ex‑parte leave, therefore the ex‑parte leave was set aside and the originating summons dismissed, with costs to the respondent.

The applicant failed to establish a substantial connection with Hong Kong because both parties were not physically present or resident in Hong Kong at the relevant times, ownership of the Property and other weak ties (bank accounts, historic employment, deregistered company) were insufficient to establish the required substantive connection; accordingly the statutory jurisdiction under s29AE was not made out and leave under s29AC was refused.

Applicant's grounds do not demonstrate a reasonable prospect of success on appeal and there are no other reasons in the interests of justice to hear the appeal; the trial judge's factual findings on health, finances, timing for vacatur and sale and consideration of the son's exams were adequately reasoned and not shown to be plainly wrong, therefore leave to appeal is refused.

Having considered overall success and conduct, and that the parties reached a compromised settlement at FDR with each side achieving some of their aims and some unreasonable positions (notably the mother's exaggerated removal cost claim), the court ordered the father to contribute 50% towards the mother's costs of and occasioned by the ancillary relief proceedings, to be taxed on a party and party basis if not agreed, including the costs of the application and with a certificate for counsel.
