The plaintiff failed to prove on the balance of probabilities that the $48,000 payment was incurred for removal of the Metal Rooftop: the First Quotation described different locations, communications establishing a linkage occurred only after the fact and were hearsay of limited weight, key witnesses/contractors were not called and documentary and pleading support was insufficient; accordingly the claim for $48,000 is dismissed.

Having considered overall success and conduct, and that the parties reached a compromised settlement at FDR with each side achieving some of their aims and some unreasonable positions (notably the mother's exaggerated removal cost claim), the court ordered the father to contribute 50% towards the mother's costs of and occasioned by the ancillary relief proceedings, to be taxed on a party and party basis if not agreed, including the costs of the application and with a certificate for counsel.
