The Court accepted the trial judge's findings that the letter did not identify the plaintiff and that witness evidence supported the statements about the night-shift manager's conduct; therefore the defendants proved a justification/privileged occasion and the plaintiff failed to show malice or that the trial judge's factual findings were clearly wrong, so the appeal is dismissed.

There was no proven material lie in the Defendant's affidavit; the impugned pleadings failed to plead identification for the slander claim and were properly struck out by the Master; the Master's order is affirmed and the appeal is dismissed with costs.

Leave to appeal was granted because the issue of whether the defence of fair comment applied to the statements in the programme raised matters of significant public importance for media freedom and it was at least reasonably arguable that the Court of Appeal's reversal of the trial judge on fair comment was unwarranted; accordingly the Court of Final Appeal granted leave without restriction on issues that may be canvassed.
