    Court
    Family Court
    Case number
    FCMC664/2016

There had been a significant change of circumstances since the consent order of 27 October 2016. The court accepted the Father's evidence of reduced and uncertain income and rejected the Mother's unsubstantiated allegations of concealed income. Balancing need and ability, the court varied the consent order to reduce child maintenance to HKD10,000 per child per month (total HKD20,000) and maintained the Mother's maintenance at HKD5,000 per month, backdating the variation to February 2019; arrears were recalculated accordingly and enforcement/repayment directions were given.

    Family Court
    Case number
    FCMC1915/2019

The court granted interim maintenance of HK$4,000 per child per month (HK$8,000 total) because the Petitioner's itemised child expenses were reasonable, there was insufficient evidence that the Danish properties produced accessible net income to the Petitioner, it was reasonable not to impute a nominal income to the Petitioner while caring for a newborn, and the Respondent had capacity to pay an additional HK$3,000 per month above his existing payments.

The court assessed and fixed the child's reasonable monthly expenses at HK$16,470, rejected the additional Wan Chai rent as not necessary, found some of applicant's expense claims inflated and found respondent had undeclared secondary income so his earning capacity was assessed at HK$65,000–70,000; applying parties' relative earning capacities the respondent was ordered to pay two‑thirds of the child's expenses, rounded to HK$11,000 per month from 28 March 2017.

    L v. W

    Citation
    L v. W
    Court
    Family Court
    Case number
    FCMC9692/2006

The judge determined net monthly incomes (W HK$65,000; H HK$55,560), found the children's expenses and the accommodation reasonable in the Hong Kong context, concluded it was fair to backdate maintenance to the children's arrival because the petitioner had been sole supporter and faced imminent loss of income, and therefore ordered specified interim payments and repayment instalments with accounting for sums already paid by the respondent.
