Because the probate action was finally determined that the 2nd Defendant is the lawful adopted daughter and the Plaintiff has no interest in the estate, the Plaintiff lacked locus standi to represent the estate; therefore the representation order appointing the Plaintiff is set aside and the originating summons is struck out, and the Plaintiff must pay the 2nd Defendant's costs in the Court of First Instance; appointment of an administratrix must be sought in the Probate Registry.
