The application for leave to appeal was refused because the sentencing judge lawfully applied appropriate starting points, discounts and the totality principle; the two month assistance discount and the decision to order nine months of the tenth month consecutive were within reasonable sentencing discretion given the applicant's serious criminal record and the separate, serious nature of the incidents, so the overall sentence was not manifestly excessive.

Section 20(2) of the Societies Ordinance does not require proof of formal membership to convict for acting as a member; where expert and eyewitness evidence proves that a defendant responded to a triad summons and took part in conduct a triad commonly undertakes, an inference that he acted as a member is justified absent contrary evidence; naming a specific triad in the charge is unnecessary; on these bases the convictions and sentences were upheld and applications for leave to appeal were refused or dismissed.

The conviction for attending a meeting of a triad society was unsafe because the magistrate was not shown to be sure the gathering was a meeting of a triad society; however, the evidence proved membership and that the appellant attended and participated in disciplinary triad business, and under s.119(1)(g) the appellate court properly substituted a conviction for the alternative offence of acting as a member of the Sun Yee On Triad Society.
