The court held that Dr Kahan's medical assessment met the s93–s100 statutory requirements: it provided adequate, job‑specific reasoning, addressed grip strength and chronic pain, and recorded the claimant's agreement; consequently the insurer's determination that the appellant had capacity for four nominated occupations and the suspension of weekly compensation was upheld and the appeal dismissed.

The appeal is dismissed because the Court accepted the existence of the decisions and lacked jurisdiction to advance a claim that Catalyst acted without authority; the IRP dated 1 August 2001 contained no entitlements so no review or appeal lay under clause 34(2) and any procedural omission caused no prejudice; the medical assessment complied with s100 by addressing occupational assessment information in medical terms, omission of the caretaker role was immaterial and advantaged the appellant, and delay in delivery of the medical report did not breach a time limit nor cause prejudice.

The occupational and medical assessments were deficient and lacked necessary reasons: the 'Tour Guide' option was effectively a self‑employment venture unsuitable given lack of finance; the occupational assessor gave no basis for finding a dyslexic, illiterate person suitable as a Meter Reader; the medical assessor's finding that a Waiter role was suitable was inconsistent with his own recorded functional limits and lacked explanation. Because the assessments did not transparently establish capacity for work under s15, the respondent's decision to cease weekly compensation was quashed.

The statutory three‑month time limit for review applications under the Accident Insurance Act 1998 is mandatory and does not permit the Review Officer to accept late applications; therefore the review application lodged after the period is ineffective and the original decision stands.

The Court found the respondent had carried out the gazetted WCAP procedure after reasonable vocational rehabilitation, that the occupational and medical assessments (Dr Hyde and Dr Friedman) validly identified suitable work (conservation shop duties, hardware assistant with allowances, veterinary/kennel assistant without heavy lifting), and therefore the respondent correctly assessed the appellant as having a capacity for work under s51(2); the decision of 19 November 1998 was confirmed and the appeal dismissed.

Because s51 establishes a distinct 'capacity for work' test applied via the s50 gazetted procedure, and the occupational and medical assessments (notably Mr Talbot) objectively supported that the appellant could build to 30+ hours per week within the permitted ramp‑up period, the Review Officer correctly found the appellant had a capacity for work and the cessation of weekly compensation from 30 April 1999 was lawful.
